Labor Department proposes rule to clarify employee vs. independent contractor status under federal wage laws

The Department of Labor’s Wage and Hour Division proposed a rule to clarify how to determine whether a worker is an employee or an independent contractor under the Fair Labor Standards Act. The proposal would rescind the department’s 2024 final rule and replace it with a new analysis framework, which could affect how some workers are classified for wage-and-hour protections.
