Labor, HHS, and Treasury propose rule to expand employer fertility benefits via new “limited excepted benefits” category

The Departments of Labor, Health and Human Services, and Treasury issued a proposed rule to create a new category of “limited excepted benefits” aimed at making it easier for employers to offer fertility benefits, including IVF-related coverage, directly to employees. The change could broaden access to fertility services depending on how employer plans adopt the new pathway after the rule is finalized.
